This policy explains how MICE Group Holdings Pty Ltd (ABN 66 641 341 862) trading as Ever Coffee (we, us) collects, uses, stores and shares personal information through evercoffee.au and our pickup counters. We follow the Australian Privacy Principles in the Privacy Act 1988 (Cth) as a matter of policy, whether or not the Act requires us to, and we comply with the Spam Act 2003 for marketing.
1. What we collect
- Order and account details: name, email, phone, delivery and billing address, order history, subscription settings, and messages you send us.
- Payment details: payments are processed by Shopify Payments, PayPal, Afterpay or Apple/Google Pay. We do not see or store your full card number; we receive a token, the card type and last four digits.
- Site usage: IP address, device and browser type, pages viewed, referring site, and actions such as adding to cart, collected through cookies and similar technologies (see section 6).
- Marketing preferences: whether you have opted in to email or SMS, and how you interact with our messages.
- Reviews and content you choose to post.
We do not collect sensitive information (such as health or biometric data) and ask that you do not send it to us. Our services are not directed at children under 16.
2. How we collect it
Directly from you when you order, create an account, subscribe, contact us, enter a promotion or post a review; automatically from your device when you use the Site; and from service providers such as our payment processors and delivery carriers (for example delivery status).
3. Why we use it
- To process, deliver and support your orders and subscriptions, including sending order, shipping and renewal-reminder emails (these are service messages, not marketing).
- To answer your questions and resolve problems, including consumer-guarantee claims.
- To run and improve the Site, prevent fraud and keep our systems secure.
- To send marketing emails or SMS about our coffee, tools and offers only if you have opted in. You can opt out at any time using the unsubscribe link or reply STOP, and we action opt-outs within 5 business days.
- To comply with the law, including tax and consumer-law record keeping.
We do not sell personal information. We do not use automated decision-making that has a legal or similarly significant effect on you.
4. Who we share it with
Only as needed to run the business:
- Shopify Inc. — our store platform and payment processing (data is stored on Shopify infrastructure in Canada, the United States and Ireland).
- Payment providers — Shopify Payments (Stripe), PayPal, Afterpay, Apple Pay, Google Pay.
- Delivery carriers — Australia Post and other carriers receive your name, address, phone and email for delivery and tracking.
- Email and SMS platforms (for example Shopify Email/Klaviyo) to send messages you have agreed to receive.
- Analytics and advertising platforms (Google Analytics, Google Ads, Meta) receive site-usage data through cookies and pixels — see section 6.
- Review platforms if you leave a review; our accountants, lawyers and IT providers under confidentiality; and government agencies where the law requires.
Some of these providers store or process information overseas, principally in the United States, Canada, Ireland and Singapore. We take reasonable steps to ensure they protect it to a standard consistent with Australian privacy law.
5. Security and retention
Our Site is served over HTTPS, payments are PCI-DSS compliant through our providers, and access to customer data is limited to team members who need it. We keep order records for at least 7 years for tax and consumer-law purposes, and delete or de-identify other information when it is no longer needed. If a data breach occurs that is likely to cause you serious harm, we will notify you and the Office of the Australian Information Commissioner (OAIC) as required.
6. Cookies, pixels and tracking
We use cookies and similar technologies that are: essential (cart, checkout, login, fraud prevention); analytics (Shopify Analytics, Google Analytics — how the Site is used); and advertising (Google Ads and Meta pixels — to measure campaigns and show you relevant ads on other sites). You can control cookies through your browser settings and opt out of interest-based advertising at youronlinechoices.com.au, adssettings.google.com and in your Meta ad preferences. Blocking essential cookies may stop the Site working.
7. Access, correction and deletion
You can view and update your details in your account, or email gday@evercoffee.au to ask for a copy of the personal information we hold about you, to correct it, or to have it deleted (subject to records we must keep by law). We will respond within 30 days and will not charge you for a reasonable request.
8. Complaints
If you are concerned about how we have handled your information, email gday@evercoffee.au and we will investigate and reply within 30 days. If you are not satisfied with our response you can complain to the OAIC at oaic.gov.au or 1300 363 992.
9. Changes
We may update this policy from time to time; the current version is always on the Site with the date at the top. Material changes will be flagged on the Site or by email.
